BACKGROUND AND PURPOSE 

Currently, in a municipality with a population of 1.5 million or more a
private vendor or county may not establish a jail, detention center, work
camp or related facility within one-half mile of a public school,
institution of higher education, or place of worship. This statute applies
to cities which join a county to build such facilities but does not apply
to cities or counties acting alone. S.B. 592 would allow a city to join
with a county to establish a jail, detention center, work camp or related
facility within one-half mile of an institution of higher education in a
municipality with a population of 1.5 million or more.  

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 361.067, Local Government Code, as follows: (a)
Creates Subsection from existing text. (b) Provides that Subsection (a)
does not apply to a booking facility, operated jointly by a county and a
municipality, that is located within one-half mile of an institution of
higher education. 

SECTION 2. Effective date. 

EFFECTIVE DATE

Upon passage, or if the Act does not receive the necessary vote, the Act
takes effect, September 1, 2003.
