SRC-DBM S.B. 602 78(R) BILL ANALYSIS Senate Research Center S.B. 602 78R2261 KSD-DBy: Ellis, Rodney Health & Human Services 3/18/2003 As Filed DIGEST AND PURPOSE Under current Texas law, the Department of Protective and Regulatory Services (DPRS) is authorized to obtain criminal background histories from the Department of Public Safety regarding certain persons. As proposed, S.B. 602 expands the list of people about whom criminal background information may be obtained by DPRS to include a person who is an employee, volunteer, or applicant volunteer of a children's advocacy center. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 411.114(a)(3), Government Code, to provide that the Department of Protective and Regulatory Services is entitled to obtain from the Department of Public Safety (DPS) criminal history information maintained by DPS that relates to a person who is an employee, volunteer, or applicant volunteer of a children's advocacy center under Chapter 264E (Children's Advocacy Centers), Family Code. SECTION 2. Effective date: September 1, 2003.
