S.B. 613 78(R) BILL ANALYSIS S.B. 613 By: Nelson Law Enforcement Committee Report (Unamended) BACKGROUND AND PURPOSE Senate Bill 613 amends the Transportation Code provision that automatically suspends the license of a person under 21 years of age for a conviction of chemical abuse to correct a cross-reference to the applicable Health and Safety Code chapter and adds one term to maintain consistency with that chapter. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 613 amends Section 521.342(a), Transportation Code, to replace a reference to Chapter 484, Health and Safety Code with Chapter 485 (Abusable Volatile Chemicals), and adds the word "abusable," so that the reference in the Transportation Code is consistent with the applicable Health and Safety Code provisions regarding the manufacture, delivery, possession, transportation, or use of an abusable volatile chemical. EFFECTIVE DATE This Act takes effect September 1, 2003.
