SRC-VRA S.B. 633 78(R) BILL ANALYSIS Senate Research Center S.B. 633 By: Gallegos Intergovernmental Relations 3/10/2003 As Filed DIGEST AND PURPOSE Currently, the complainant, the ultimate-decision maker regarding discipline, and any person who has personal involvement regarding the alleged misconduct of a police officer or firefighter are prohibited from conducting an investigation. As proposed, S.B. 633 would require that a police officer or fire fighter be informed in writing of the nature of an investigation and the name of each person who complained. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 143.123(e), Local Government Code, to add new language to existing text to require an investigator to inform a fire fighter or police officer in writing of the nature of the investigation and the name of each person who complained about the fire fighter or police officer concerning the matters under investigation within 30 days of receiving the complaint. SECTION 2. Effective date: September 1, 2003.
