SRC-LBB S.B. 646 78(R) BILL ANALYSIS Senate Research Center S.B. 646 78R2248 MCK-DBy: Wentworth Business & Commerce 4/1/2003 As Filed DIGEST AND PURPOSE Currently, an individual is authorized to contest an application to sell beer, but the individual may be required to pay the costs of the protest if the case is decided in favor of the applicant. As proposed, S.B. 646 prohibits an individual from being required to pay security for the costs related to contesting an application to sell certain alcoholic beverages. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 61.39, Alcoholic Beverage Code, to prohibit a person from being required to pay security for the costs relating to contesting an application for certain alcoholic beverage licenses, if the case should be decided in favor of the applicant. Deletes language prohibiting security for costs from being required of an officer of a county or incorporated city or town. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
