DIGEST AND PURPOSE 

Currently, a municipality is not allowed to consider contracting with
minority and women-owned businesses in determining the "best value" for a
municipality.  C.S.S.B. 689 
allows the consideration of contracts with minority-owned and women-owned
businesses when awarding best value procurements. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 252.043(b), Local Government Code, to authorize
a  municipality to consider, in addition to other items relating to the
awarding of contracts by a municipality and the best value for the
municipality, the impact on the ability of the municipality to comply with
laws, rules, and programs relating to contracting with historically
underutilized businesses, minority-owned and women-owned businesses, and
nonprofit organizations employing persons with disabilities.  Makes
nonsubstantive changes. 

SECTION 2.  Effective date:  September 1, 2003.
