DIGEST AND PURPOSE 

Currently, the occupancy of a correctional facility operated by a city or
county cannot exceed more than 2,000 inmates, on a daily basis.  Galveston
County and the city of Galveston are combining their inmates under one
facility until the constructing a new jail house for all their detainees
is built, and will exceed the cap of 2,000 inmates.  C.S.S.B. 704
increases the maximum inmate population of a correctional facility
operated by a city or a county.    

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 361.065, Local Government Code, to require a
facility authorized by this subchapter to be designed, constructed,
operated. and maintained to hold not more than an average daily population
of 4,000, rather than 2000, inmates. 

SECTION 2.  Effective date: upon passage or September 1, 2003.

SUMMARY OF COMMITTEE CHANGES

SECTION 1.  Differs from the original bill in SECTION 1 by  amending the
"Local Government Code," rather than the "Government Code."
