SRC-JLB S.B. 706 78(R) BILL ANALYSIS Senate Research Center S.B. 706 78R5552 MI-DBy: Jackson Intergovernmental Relations 3/29/2003 As Filed DIGEST AND PURPOSE Currently, a records management and preservation fee of $5 is collected by the county clerk for filing and recording documents. The fee is charged for all suits or actions filed and is only used to provide funds for management and preservation. As proposed, S.B. 706 allows a county clerk to collect a fee, not to exceed $10, for record preservation and management. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 118.011(b), Local Government Code, to authorize the county clerk to set and collect certain fees, including $10, rather than $5, for the Records Management and Preservation Fee, Section 118.0216, Local Government Code. SECTION 2. Effective date: September 1, 2003.
