C.S.S.B. 708 clarifies that the commissioners court can delegate that authority to public health districts. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 240.002, Local Government Code, by adding Subsection (c) to authorize a commissioners court of a county to delegate the authority granted under Subsection (a) to a county health department or a public health district established under Subchapter E, Chapter 121, Health and Safety Code (Local Public Health Reorganization Act). SECTION 2. Effective date: upon passage or September 1, 2003.
