DIGEST AND PURPOSE 

Currently, Section 263.053, Local Government Code, applies to counties
with populations greater than 500,000.  As proposed, S.B. 709 applies
Section 263.053, Local Government Code, to counties with a population of
more than 250,000, rather than 500,000, which includes eight more Texas
counties (Collin, Denton, Fort Bend, Cameron, Nueces, Montgomery,
Jefferson, and Galveston). 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends the heading to Section 263.053, Local Government Code,
to read as follows: 

Sec.  263.053.  SALE AND SUBSEQUENT LEASE OF PROPERTY IN COUNTIES WITH
POPULATION OF MORE THAN 250,000. 

SECTION 2.  Amends Section 263.053(a), Local Government Code, to provide
that this section applies only to counties with a population of more than
250,000, rather than 500,000. 

SECTION 3.  Effective date:  upon passage or September 1, 2003.
