C.S.S.B. 709 applies Section 263.053, Local Government Code, to counties with a population of more than 250,000, rather than 500,000, which includes eight more Texas counties (Collin, Denton, Fort Bend, Cameron, Nueces, Montgomery, Jefferson, and Galveston). RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends the heading to Section 263.053, Local Government Code, to read as follows: Sec. 263.053. SALE AND SUBSEQUENT LEASE OR LICENSE OF PROPERTY IN COUNTIES WITH POPULATION OF MORE THAN 250,000. (a) Provides that this section applies only to counties with a population of more than 250,000, rather than 500,000. (b) Authorizes the commissioners court of the county to enter into any for-profit or other licensing agreement with a seller of wireless communications service that may include a license to collocate wireless communications technology on property owned by the county.
