SRC-LBB C.S.S.B. 727 78(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 727 78R9712 EMT-DBy: Staples Criminal Justice 5/8/2003 Committee Report (Substituted) DIGEST AND PURPOSE C.S.S.B. 727 authorizes the comptroller to pay a single claim or an aggregate of claims by a single claimant in an amount not to exceed $50,000 in relation to the payment of fees awarded to certain attorneys appointed by a court to represent indigent inmates in capital cases. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 403.074, Government Code, by amending Subsection (d) and adding Subsection (h), as follows: (d) Provides an exception. (h) Authorizes the comptroller to pay a single claim in an amount not to exceed $50,000 or an aggregate of claims by a single claimant during a biennium in a total amount not to exceed $50,000 to cover the fees awarded to an attorney appointed by a court under Section 26.051(g), Code of Criminal Procedure, to represent an indigent inmate in a capital case. SECTION 2. (a) Effective date: September 1, 2003. (b) Makes application of this Act prospective.
