DIGEST AND PURPOSE 

S.B. 735 permits county and city officials to be appointed to serve on
state boards and commissions, while prohibiting them from receiving
compensation for serving in that capacity.  Under the bill's provisions,
such officials are allowed to be compensated for expenses incurred in the
course of their duties. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 574, Government Code, by adding Section
574.005, as follows: 

Sec.  574.005.  LOCAL GOVERNMENT OFFICERS ON STATE GOVERNING BODIES.  (a)
Defines "local government" and "state agency." 

(b)  Authorizes an individual who holds an elected or appointed local
government office to be appointed to the governing body of a state agency
if otherwise eligible.  Prohibits the individual from receiving
compensation for serving on the governing body of the agency but
authorizes the individual to be reimbursed for certain costs as provided
by other law. 

(c)  Provides that rules adopted under Section 574.003 are not required
for the implementation of this section. 

SECTION 2.  Effective date: upon passage or September 1, 2003.
