SRC-MSY S.B. 809 78(R) BILL ANALYSIS Senate Research Center S.B. 809 78R5154 JD-FBy: Harris Infrastructure Development and Security 3/20/2003 As Filed DIGEST AND PURPOSE Under current Texas law, members of the public can obtain an airport's structural information, emergency response plans, and related information that could be considered sensitive through public information requests. As proposed, S.B. 809 makes such information related to airports exempt from public disclosure. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 552C, Government Code, by adding Section 552.145, as follows: Sec. 552.145. EXCEPTION: INFORMATION RELATED TO THE SECURITY OR VULNERABILITY OF AIRPORT INFRASTRUCTURE, BUILDINGS, AND OPERATIONS. (a) Exempts information from the requirements of Section 552.021 if it is information that relates to the security or vulnerability of airport infrastructure, buildings, or operations, including certain information. (b) Provides that Section 552.007(a) does not apply to an item of information described by Subsection (a) merely because the information has been disclosed to certain governmental bodies, or certain private contractors or consultants, provided that the contractors or consultants have signed a certain confidentiality agreement. (c) Provides that this section does not limit the application of Section 552.101 to information excepted from disclosure by this section. SECTION 2. Effective date: upon passage or September 1, 2003.
