SRC-JLB S.B. 838 78(R) BILL ANALYSIS Senate Research Center S.B. 838 78R2926 YDB-FBy: Armbrister Intergovernmental Relations 3/28/2003 As Filed DIGEST AND PURPOSE Currently, the district attorney of Wharton County has jurisdiction for all criminal cases, including juvenile cases. As proposed, S.B. 838 transfers juvenile jurisdiction from the district attorney to the county attorney. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 43.1775(c), Government Code, to authorize the district attorney, at the request of the county attorney, to assist the county attorney in the prosecution of juvenile cases under Title 3, Family Code. SECTION 2. Amends Section 45.341, Government Code, by adding Subsections (d) and (e), as follows: (d) Provides that the county attorney represents the state in proceedings under Title 3, Family Code. (e) Provides that the county attorney represents the Wharton County Drainage District. SECTION 3. Makes application of this Act prospective. SECTION 4. Effective date: September 1, 2003.
