SRC-MSY S.B. 839 78(R) BILL ANALYSIS Senate Research Center S.B. 839 78R5406 CBH-FBy: Duncan State Affairs 3/24/2003 As Filed DIGEST AND PURPOSE The Utilities Code currently sets forth a general standard for gas transportation service, but does not specify that a gas utility may not require anything above and beyond that standard as a condition of service. Therefore, a gas utility may make a state agency take on additional costs as a result of services, instruments, or facilities that are not normally required by the utility. As proposed, S.B. 839 prohibits a gas utility from requiring a different level of service, instrumentalities, or facilities than the utility normally provides as a condition of service for providing transportation services for the agency. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 104.251, Utilities Code, to prohibit a gas utility from requiring a different level of service, instrumentalities, or facilities than the utility normally provides as a condition for providing transportation services for a state agency. SECTION 2. Effective date: upon passage or September 1, 2003.
