S.B. 841 78(R) BILL ANALYSIS S.B. 841 By: Whitmire Law Enforcement Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, the Private Investigators and Private Security Agencies Act (Private Security Act) enables full-time active peace officers who are employed by a municipality or the state to work off-duty employment as well as to supervise and coordinate scheduling as an extra job coordinator for other municipal or state peace officers to work off-duty as guards, patrolmen, or watchmen. Senate Bill 841 modifies the definition of "extra job coordinator" in the Private Security Act to make it applicable to full-time employees of a political subdivision of the state. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 841 amends Section 1702.002(7), Occupations Code, to replace the word "municipality" with "political subdivision of the state," so that the definition of "extra job coordinator" includes a peace officer employed in that position by a political subdivision. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003.
