SRC-AMY S.B. 846 78(R) BILL ANALYSIS Senate Research Center S.B. 846 78R5661 KEG-FBy: Barrientos Criminal Justice 5/10/2003 As Filed DIGEST AND PURPOSE As proposed, S.B. 846 establishes a process for a Department of Public Safety-commissioned officer efficiency report including requiring the officer's immediate supervisor to prepare an initial report and for the next immediate supervisor to review the report along with the officer's written comments or information. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 411.007(d), Government Code, to require the officer's immediate supervisor, if the employee is an officer commissioned by the Department of Public Safety (DPS), annually to prepare an initial report of the officer's efficiency and present that report to the officer for review and comment. Requires DPS, after the officer has been given a reasonable opportunity to review the report and attach additional written information or comments, to require the officer to forward the report, together with any written information or comments added by the officer, to the officer's next immediate supervisor. Requires a supervisor at each intermediate level of supervision of the officer to review the report and either concur in the evaluations and decisions made by the officer's immediate supervisor or supplement the report by providing additional information or comments. Requires any additional information or comments provided by the officer or a supervisor of the officer to be kept with the report in DPS's permanent files and be given appropriate consideration as part of the report in all matters related to promotion and discharge of the officer. SECTION 2. Effective date: September 1, 2003.
