SRC-AMY S.B. 863 78(R) BILL ANALYSIS Senate Research Center S.B. 863 78R2889 MCK-DBy: Whitmire Business & Commerce 4/8/2003 As Filed DIGEST AND PURPOSE Currently, an individual is authorized to contest an application to sell beer, but may be required to pay the costs of the protest if the case is decided in favor of the applicant. As proposed, S.B. 863 prohibits an elected officer of the state or federal government from being required to pay security costs related to contesting an application to sell certain alcoholic beverages. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 61.39, Alcoholic Beverage Code, to neutralize a gender reference and to prohibit an elected officer of the state or federal government from being required to pay security costs when contesting an alcoholic beverage license application. SECTION 2. Effective date: September 1, 2003.
