S.B. 895 78(R) BILL ANALYSIS S.B. 895 By: Bivins Law Enforcement Committee Report (Unamended) BACKGROUND AND PURPOSE Under current Texas law, the Department of Public Safety (DPS) does not have the specific authority to approve parent taught, computer-based driver education programs. As proposed, Senate Bill 895 requires DPS to provide a method by which approval for delivering course materials by an alternative method is obtained, including electronic means. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 895 amends Section 521.205(c), Transportation Code, by adding Subdivision (3) to provide that certain rules adopted by the Department of Public Safety must provide a method by which approval for delivering course materials by an alternative method is obtained, including electronic means. EFFECTIVE DATE This Act takes effect September 1, 2003.
