SRC-TJG S.B. 899 78(R) BILL ANALYSIS Senate Research Center S.B. 899 78R6990 QS-FBy: Averitt Natural Resources 4/1/2003 As Filed DIGEST AND PURPOSE Section 36.060(d), Water Code, provides that Section 36.060 prevails over any other law in conflict with or inconsistent with this section, including a special law governing a specific district. This section also states that if the application of this section results in an increase in the fees of office for any district, that district's fees of office shall not increase unless the district's board by resolution authorizes payment of the higher fees. As proposed, S.B. 899 repeals Section 36.060(d), Water Code. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 36.060(d), Water Code (relating to this section prevailing in conflict with other laws and the fees of office and reimbursement of directors of groundwater conservation districts). SECTION 2. Effective date: upon passage or September 1, 2003.
