SRC-TJG C.S.S.B. 899 78(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 899 78R10042 QS-DBy: Averitt Natural Resources 4/9/2003 Committee Report (Substituted) DIGEST AND PURPOSE Section 36.060(d), Water Code, provides that Section 36.060 prevails over any other law in conflict with or inconsistent with this section, including a special law governing a specific district. This section also states that if the application of this section results in an increase in the fees of office for any district, that district's fees of office shall not increase unless the district's board by resolution authorizes payment of the higher fees. C.S.S.B. 899 clarifies that the amount se forth for groundwater conservation district directors' per diems in Chapter 36 of the Texas Water Code only applies to districts whose directors are entitled to receive a fee of office. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 36.060(d), Water Code, to provide that Subsection (a), rather than this section, prevails over any other law in conflict with or inconsistent with that subsection, rather than this section, including a special law governing a specific district unless the special law prohibits the directors of that district from receiving a fee of office. SECTION 2. Effective date: upon passage or September 1, 2003. SUMMARY OF COMMITTEE CHANGES Differs from original in SECTION 1 by amending Section 36.060(d), Water Code, rather than repeal it.
