SRC-TAG S.B. 918 78(R) BILL ANALYSIS Senate Research Center S.B. 918 78R1660 EMT-DBy: Whitmire Criminal Justice 4/28/2003 As Filed DIGEST AND PURPOSE As proposed, S.B. 918 provides for the issuance of summons for an appearance related to certain parole violations. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 508.251, Government Code, by amending Subsection (c) and adding Subsection (c-1), as follows: (c) Requires the pardons and paroles division (division), instead of the issuance of a warrant under this section, to issue to the person a summons requiring the person to appear for a hearing under Section 508.281 if the person is arrested only on a charge of having committed an administrative violation of a condition of release; and issue to a person, other than a person to whom a summons is required to be issued under Subdivision (1), a summons requiring the person to appear for a hearing under Section 508.281. Deletes text requiring the summons to include certain information. (c-1) Requires a summons issued under Subsection (c) to state the time, date, place, and purpose of the hearing. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
