SRC-TJG S.B. 940 78(R) BILL ANALYSIS Senate Research Center S.B. 940 By: Janek Infrastructure Development and Security 4/2/2003 As Filed DIGEST AND PURPOSE Currently, only a county with a population of more than 3.3 million is allowed to establish an administrative procedure to enforce collection of tolls by toll violators that use EZ Tags. By establishing an administrative procedure, the county does not have to go through traditional criminal court procedures. As proposed, S.B. 940 allows a county adjacent to a county with a population of more than 3.3 million to establish such administrative procedures. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 284.201, Transportation Code, to add a county that is adjacent to a county that has a population of more than 3.3 million to the counties to which this subchapter applies. SECTION 2. Effective date: upon passage or September 1, 2003.
