SRC-TAG S.B. 969 78(R) BILL ANALYSIS Senate Research Center S.B. 969 78R5588 KCR-DBy: Shapleigh Criminal Justice 4/26/2003 As Filed DIGEST AND PURPOSE Currently, an assault committed against an elderly or disabled individual is enhanced from a Class C misdemeanor to a Class A misdemeanor under Section 22.01 (Assault), Penal Code. However, an assault committed against a child is regarded as Class C misdemeanor. As proposed S.B. 969 amends Section 22.01, Penal Code, to include "child" in the group of individuals against whom an assault constitutes a Class A misdemeanor. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.01(c), Penal Code, to provide that an offense under Subsection (a)(3) is Class A misdemeanor if the offense is committed against a child, as defined by Section 22.04. Makes a nonsubstantive change. SECTION 2. (a) Effective date: September 1, 2003. (b) Makes application of this Act prospective.
