SRC-VRA S.B. 979 78(R) BILL ANALYSIS Senate Research Center S.B. 979 78R5054SLO-FBy: Wentworth Jurisprudence 3/17/2003 As Filed DIGEST AND PURPOSE Currently, the 274th Judicial District is composed of Caldwell, Comal, Guadalupe, and Hays counties. The 274th District Court has concurrent jurisdiction with the 22nd and 207th District Courts in Caldwell, Comal, and Hays counties. As proposed, S.B. 979 would remove Caldwell County from the jurisdiction of the 274th Judicial District. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 24.451, Government Code, as follows: Sec. 24.451. New heading: 274th JUDICIAL DISTRICT (COMAL, GUADALUPE, AND HAYS COUNTIES). (a) Deletes Caldwell county from the 274th Judicial District. (b) Makes conforming changes. (c) Provides that the 274th District Court has the same jurisdiction as the 22nd and the 207th district courts in Comal and Hays counties and concurrent jurisdiction with the 25th and Second 25th district courts in Guadalupe County. SECTION 2. Repealer: Section 24.386(c), Government Code (207th Judicial District) SECTION 3. (a) Requires the local administrative district judge to transfer all cases from Caldwell County that are pending in the 274th District Court on September 1, 2003, to the 22nd and 107th district courts. (b) Provides that when a case is transferred as provided by Subsection (a) of this section, all processes, writs, bonds, recognizances, or other obligations issued from the 274th District Court are returnable to the 22nd or 107th [sic] District Court, as applicable, as if originally issued by that court. Provides that the obligees on all bonds and recognizances taken in and for the 274th District Court and all witnesses summoned to appear in the 274th District Court are required to appear before the 22nd or 107th [sic] District Court, as applicable, as if originally required to appear before that court. SECTION 4. Makes application of Section 24.386, Government Code, as amended by this Act, prospective. SECTION 5. Effective date: September 1, 2003.
