SRC-AMY S.B. 983 78(R) BILL ANALYSIS Senate Research Center S.B. 983 87R6381 KEG-DBy: Van de Putte Veteran Affairs & Military Installations 3/24/2003 As Filed DIGEST AND PURPOSE Currently, the language of Government Code 431.013 (Expenditures) requires the governor or the governor's designee as well as the adjutant general or the adjutant general's designee to approve expenditures. This process is unnecessary; however, the language still remains and is subject to enforcement by the comptroller. As proposed, S.B. 983 deletes the requirement that the governor or the governor's designee approve expenditures in addition to the adjutant general or the adjutant general's designee. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 431.013, Government Code, to prohibit the comptroller from issuing a warrant on or initiating an electronic funds transfer from the state treasury for an expenditure under this chapter unless it is approved by the adjutant general or the designee thereof, rather than both the adjutant general and the governor or their designees, before payment. SECTION 2. Effective date: upon passage or September 1, 2003.
