SRC-TAG S.B. 1006 78(R) BILL ANALYSIS Senate Research Center S.B. 1006 78R7117 JSA-DBy: West Subcommittee on Higher Education 3/26/2003 As Filed DIGEST AND PURPOSE Under current law, institutions of higher education are exempt from the historically underutilized business (HUB) strategic planning requirements. Since institutions of higher education were exempted from the strategic planning requirements, they were not required to engage in HUB strategic planning. As proposed, S.B. 1006 requires state institutions of higher education to develop plans to increase the use of historically underutilized businesses in purchasing and contracting. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2161.123(a), Government Code, to require each state agency, including the Texas Building and Procurement Commission (commission), that is required to have a strategic plan under Chapter 2056 to include in its strategic plan a written plan for increasing the agency's use of historically underutilized business in purchasing and public works contracting. Requires the governing board of each university system or institution of higher education not included in a university system, other than a public junior college, to prepare a written plan for increasing the use of historically underutilized businesses in purchasing and public works contracting by the system or institution. SECTION 2. Effective date: September 1,2003.
