SRC-TJG S.B. 1012 78(R) BILL ANALYSIS Senate Research Center S.B. 1012 By: West, Royce/Lucio Health & Human Services 4/11/2003 As Filed DIGEST AND PURPOSE Currently, electronic monitoring devices are allowed to be placed in residents' rooms in nursing homes. As proposed, S.B. 1012 requires the Texas Department of Human Services to adopt rules to provide for the placement of electronic monitoring devices by a family member in the room of a person with Alzheimer's disease who is a resident of an assisted living facility. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Department of Human Services in SECTION 1 (Section 247.069, Health and Safety Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 247E, Health and Safety Code, by adding Section 247.069, as follows: Sec. 247.069. MONITORING DEVICES. Requires the Texas Department of Human Services (TDHS) to adopt rules to provide for the placement of electronic monitoring devices by a family member in the room of a person with Alzheimer's disease who is a resident of an assisted living facility. SECTION 2. Effective date: September 1, 2003. SECTION 3. Requires TDHS to adopt rules under Section 247.0291, Health and Safety Code, as added by this Act, no later than January 1, 2004.
