BACKGROUND AND PURPOSE 

Currently, the Texas Department of Human Services (DHS) has the legal
authority to accept monetary donations for use in programs authorized by
federal law. DHS does not have the legal authority to accept in-kind
donations or donations for any other purpose. As proposed, Senate Bill
1051 authorizes DHS to solicit in-kind donations as well as monetary
donations and facilitate increased donations. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, department, institution, or agency.  

ANALYSIS

SECTION 1. Amends Section 22.001, Human Resources Code, by adding
Subsection (e), to authorize the Texas Department of Human Services (DHS)
to solicit and accept gifts, grants, and donations of money or property
from public or private sources for use in assisting needy persons or
otherwise carrying out any of DHS's functions.  

SECTION 2. Effective date: upon passage or September 1, 2003.
