DIGEST AND PURPOSE 

Current Texas law provides that payment of unemployment compensation
should not occur until the Texas Workforce Commission (TWC) enters an
order at a formal meeting in accordance with a court judgment.  This law
contradicts both federal and case law, which require prompt payment upon a
determination of eligibility for unemployment compensation benefits.  As
proposed, S.B. 1070 repeals the requirement for TWC to enter an order in
accordance with the final determination of an action. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Repealer: Section 212.209, Labor Code (Entry of Commission
Order on Final Determination of Judicial Proceeding). 

SECTION 2.  Effective date: upon passage or September 1, 2003.
