S.B. 1073 78(R) BILL ANALYSIS S.B. 1073 By: West Human Services Committee Report (Amended) BACKGROUND AND PURPOSE Currently, a person convicted of an offense under Chapter 31, Penal Code (Theft), is prohibited from being employed in a position of which the duties involve direct contact with a consumer in a facility serving the elderly or persons with disabilities before the fifth anniversary of the date of the conviction. Senate Bill 1073 adds certain other offenses to the list of offenses which prohibit a person from being employed in a position of which the duties involve direct contact with a consumer in a facility before the fifth anniversary of the date of the conviction. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, department, institution, or agency. ANALYSIS Section 1.Amends Section 250.006(b), Health and Safety Code, to prohibit a person from being employed in a position of which the duties involve direct contact with a consumer in a facility serving the elderly or persons with disabilities before the fifth anniversary of the date the person is convicted of a certain offense. Section 2.Effective date is September 1, 2003. EFFECTIVE DATE September 1, 2003. EXPLANATION OF AMENDMENTS Committee Amendment number 1 amends the bill by adding a new SECTION 2 by proposing that the change in law made by the Act to Section 250.006, Health and Safety Code, does not apply to a person who is employed by a facility on the effective date of this Act for the periods during which the person is continuously employed by that facility.
