SRC-TJG S.B. 1073 78(R) BILL ANALYSIS Senate Research Center S.B. 1073 By: West Health & Human Services 4/10/2003 As Filed DIGEST AND PURPOSE Currently, a person convicted of an offense under Chapter 31, Penal Code (Theft), is prohibited from being employed in a position the duties of which involve direct contact with a consumer in a facility serving the elderly or persons with disabilities (facility) before the fifth anniversary of the date of the conviction. As proposed, S.B. 1073 adds certain other offenses to the list of offenses which prohibit a person from being employed in a position the duties of which involve direct contact with a consumer in a facility before the fifth anniversary of the date of the conviction. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 250.006(b), Health and Safety Code, to prohibit a person from being employed in a position the duties of which involve direct contact with a consumer in a facility serving the elderly or persons with disabilities before the fifth anniversary of the date the person is convicted of a certain offense. Deletes existing text related to an offense under Chapter 31, Penal Code, that is punishable as a felony and text related to criminal trespass. SECTION 2. Effective date: September 1, 2003.
