BACKGROUND AND PURPOSE 

Current law requires the General Land Office (GLO) to provide support to
the Recycling Market Development Board (RMDB), and requires the GLO
commissioner to serve as the RMDB chairman S.B. 1091 removes GLO and the
Texas Department of Commerce from the RMDB, provides an alternative
chairman, and amends the Solid Waste Disposal Act by updating the names of
various affected state agencies.  

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution. 

ANALYSIS

SECTION 1. Amends Section 361.422(e), Health and Safety Code, by deleting
the General Land Office (GLO) from the list of entities whose
representatives must be part of an advisory task force convened under
certain circumstances. 
SECTION 2. Amends Section 361.423(a), Health and Safety Code, as follows:
(a) Deletes the commissioner of the GLO, the executive director of the
General Services Commission, and the executive director of the Texas
Department of Commerce from the list of persons who are on the Recycling
Market Development Board (RMDB), and adds the executive director of the
Texas Building and Procurement Commission. Makes conforming and
nonsubstantive changes.  
SECTION 3. Repealer: Sections 361.423(d), Health and Safety Code
(requiring the GLO to provide RMDB with support). Repealer: Section
361.424 (Recycling Awareness Campaign), Health and Safety Code.  
SECTION 4. (a) Requires the chairman of the Texas Commission on
Environmental Quality (TCEQ) to assume the office of presiding officer of
RMDB on this Act's effective date if the GLO commissioner or the executive
director of the Texas Department of Economic Development is or is
scheduled to become the presiding officer on the effective date. Requires
the TCEQ chairman to serve in that capacity until the next regularly
scheduled rotation of service in that office under Section 361.423(a),
Health and Safety Code. (b) Effective date: September 1, 2003.
