SRC-TAG, EPT S.B. 1158 78(R) BILL ANALYSIS Senate Research Center S.B. 1158 By: Averitt Natural Resources 4/1/2003 As Filed DIGEST AND PURPOSE Currently, all revenue generated by the motorboat registration fee and the motorboat manufacturer or dealer registration fee is statutorily dedicated to Fund 9, the Game, Fish and Water Safety Account. As proposed, S.B. 1158 changes the allocation of funds generated from the motorboat registration fees that are dedicated to Fund 9 from 100 percent to 85 percent. Furthermore, this bill requires that the remaining 15 percent of revenue generated from the motorboat registration fee be dedicated to Fund 64, the State Parks Account. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.032(b), Parks and Wildlife Code, to require the Texas Parks and Wildlife Department (TPWD) to deposit to the credit of the game, fish, and water safety account all revenue, less allowable costs, or the percentage of revenue prescribed by this subsection, less allowable costs, from certain sources including 85 percent of the total amount of collected motorboat registration fees and 85 percent of the total amount of collected motorboat manufacturer or dealer registration fees. SECTION 2. Amends Section 11.035(b), Parks and Wildlife Code, to require TPWD to deposit to the credit of the state parks account all revenue, less allowable costs, or the percentage of revenue prescribed by this subsection, less allowable costs, received from certain sources including 15 percent of the total amount of collected motorboat registration fees and 15 percent of the total amount of collected motorboat manufacturer or dealer registration fees. SECTION 3. Effective date: September 1, 2003.
