S.B. 1183 78(R) BILL ANALYSIS S.B. 1183 By: Deuell Economic Development Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, the Texas Workforce Commission (TWC) administers the federal community service program under the National and Community Service Act of 1990. The functions and activities of this program are expected to be incorporated into the OneStar Foundation. To move the program under the authority and coordination of the OneStar Foundation, the ties to TWC must be severed. SB 1183 removes the federal community service program from the Texas Workforce Commission and the Council Workforce and Economic Competitiveness. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SB 1183 amends Section 302.021(a), Labor Code, to delete the community service program under the National and Community Service Act of 1990 (42 U.S.C. Section 12501 et seq.) from the list of job-training, employment, and employment-related educational programs and functions that are consolidated under the authority of the division of workforce development of the Texas Employment Commission, now the Texas Workforce Commission. The bill also redesignates Subdivisions (16) (19) as Subdivisions (15) - (18). SB 1183 amends Section 2308.102(b), Government Code, to delete the National and Community Service Act of 1990 (42 U.S.C. Section 12501 et seq.) from the list of federal laws over which the Council on Workforce and Economic Competitiveness is required to assume responsibility. The bill also redesignates Subdivisions (4) - (8) as Subdivisions (3) - (7). EFFECTIVE DATE September 1, 2003.
