DIGEST AND PURPOSE 

Current law limits liability for municipal  park systems that install
skate parks.  C.S.S.B. 1205 extends limits on liability to county and
state skate parks. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 75.002, Civil Practice and Remedies Code, by
amending Subsections (e), (f), and (g), as follows: 

(e)  Includes "the state" and "county" in reference to ownership or
operation in the definition of "recreation."  Replaces "inside a facility"
with "on premises" in relation to the location where certain recreational
activities occur. 

 (f)  Makes a conforming change.

 (g) Makes conforming changes.

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Effective date:  September 1, 2003.
