SRC-VRA S.B. 1223 78(R) BILL ANALYSIS Senate Research Center S.B. 1223 78R7544 DRH-DBy: Hinojosa Intergovernmental Relations 4/25/2003 As Filed DIGEST AND PURPOSE Current Texas law mandates that a building erected in an unincorporated area of the county must have a permit from the county to build. As proposed, S.B. 1223 grants municipalities authority over construction in their own extraterritorial jurisdictions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 233, Local Government Code, by adding Subchapter Z, as follows: SUBCHAPTER Z. MISCELLANEOUS PROVISIONS Sec. 233.901. COUNTY BUILDING PERMIT IN EXTRATERRITORIAL JURISDICTION PROHIBITED. Prohibits a county from requiring a permit to erect or improve a building or other structure in the extraterritorial jurisdiction of a municipality, as defined by Chapter 42. SECTION 2.Effective date: September 1, 2003. Makes application of this Act prospective.
