SRC-MSY S.B. 1232 78(R) BILL ANALYSIS Senate Research Center S.B. 1232 By: Wentworth Education 3/23/2003 As Filed DIGEST AND PURPOSE Under current law, school districts may fill open positions before notifying existing staff that the positions were available. As proposed, S.B. 1232 requires a school district to post job vacancies in a public place for 10 days before filling a position, and requires all current employees to be given an opportunity to apply for open positions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.163, Education Code, by adding Subsection (d) to require the school district employment policy to provide that all job vacancies be posted for at least 10 working days by the district in a place readily accessible to the public and that all current employees be given an opportunity to apply for open positions. SECTION 2. Provides that this Act applies beginning with the 2003-2004 school year. SECTION 3. Effective date: upon passage or September 1, 2003.
