SRC-JEC, MSY S.B. 1232 78(R)BILL ANALYSIS Senate Research CenterS.B. 1232 By: Wentworth Education 4/11/2003 Committee Report (Amended) DIGEST AND PURPOSE Under current law, school districts may fill open positions before notifying existing staff that the positions were available. S.B. 1232 requires a school district to post job vacancies for which they had ample notice in a public place for 10 days before filling a position, and requires all current employees to be given an opportunity to apply for open positions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.163, Education Code, by adding Subsection (d), as follows: (d) Requires the school district employment policy to provide that all job vacancies be posted for at least 10 working days by the district in a place readily accessible to the public and that all current employees be given an opportunity to apply for open positions. SECTION 2. Provides that this Act applies beginning with the 2003-2004 school year. SECTION 3. Effective date: upon passage or September 1, 2003. LIST OF AMENDMENTS In SECTION 1 of the bill, add a new Subsection (e), as follows: (e) Provides that if a school district has less than 10 days notice during the school year that a job vacancy will occur in a teaching position, the district is required to post the job vacancy but is authorized to proceed to fill the vacant position.
