SRC-TJG S.B. 1248 78(R) BILL ANALYSIS Senate Research Center S.B. 1248 By: Armbrister Criminal Justice 4/22/2003 As Filed DIGEST AND PURPOSE Current law prohibits political subdivisions and agencies of this state from maintaining a system of traffic ticket quotas, whereby an officer is required to issue a certain number of citations. It is possible for a governmental body to circumvent the prohibition on quotas, by evaluating the officer based on the number of traffic stops, "contacts," or arrests made involving the enforcement of traffic laws. As proposed, S.B. 1248 extends the prohibition on quotas to include arrests for Penal Code offenses and to include quotas on "contacts" or traffic stops. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 720.002(a) and (f), Transportation Code, as follows: (a) Prohibits a political subdivision or an agency of this state from in any manner establishing or maintaining, formally or informally, a plan to evaluate in any manner, promote, compensate, or discipline certain individuals according to certain criteria. (f) Defines "traffic contacts." Redesignates existing Subdivision (2) as (3). SECTION 2. Effective date: September 1, 2003.
