DIGEST AND PURPOSE 

Current law prohibits political subdivisions and agencies of this state
from maintaining a system of traffic ticket quotas, whereby an officer is
required to issue a certain number of citations.  It is possible for a
governmental body to circumvent the prohibition on quotas, by evaluating
the officer based on the number of traffic stops, "contacts," or arrests
made involving the enforcement of traffic laws.  C.S.S.B. 1248 extends the
prohibition on quotas to include arrests for Penal Code offenses and to
include quotas on "contacts" or traffic stops. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends [Chapter 720,] Transportation Code, by adding Section
720.0021, as follows: 

Sec. 720.0021.  PROHIBITION ON QUOTAS FOR ENFORCEMENT ACTIONS BY PEACE
OFFICERS EMPLOYED BY THE STATE.  (a) Prohibits an agency of this state
from in any manner establishing or maintaining, formally or informally, a
plan to evaluate in any manner, promote, or discipline a peace officer
according to certain criteria. 

SECTION 2.  Effective date: September 1, 2003.
