SRC-JEC S.B. 1305 78(R) BILL ANALYSIS Senate Research Center S.B. 1305 By: Lucio State Affairs 4/17/2003 As Filed DIGEST AND PURPOSE Under the Charitable Immunity and Liability Act, certain charitable organizations and their employees and volunteers are protected from liability for grievances arising from actions related to the charitable organization's work. As proposed, S.B. 1305 extends the protections to certain private primary or secondary schools. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subdivision (1), Section 84.003, Civil Practice and Remedies Code, to redefine "charitable organization" to include private primary or secondary schools accredited by the Southern Association of Colleges and Schools. Makes conforming changes. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
