SRC-JEC C.S.S.B. 1305 78(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 1305 By: Lucio State Affairs 5/10/2003 Committee Report (Substituted) DIGEST AND PURPOSE Under the Charitable Immunity and Liability Act, certain charitable organizations and their employees and volunteers are protected from liability for grievances arising from actions related to the charitable organization's work. C.S.S.B. 1305 extends the protections to certain private primary or secondary schools. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 84.003(1), Civil Practice and Remedies Code, to redefine "charitable organization" to include private primary or secondary schools accredited by a member association of the Texas Private School Accreditation Commission, but excluding fraternities, sororities, and secret societies, rather than alumni associations and related on-campus organizations. Makes conforming changes. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
