SRC-VRA S.B. 1315 78(R) BILL ANALYSIS Senate Research Center S.B. 1315 By: Van de Putte Health & Human Services 4/23/2003 As Filed DIGEST AND PURPOSE Current Texas law does not permit the Texas State Board of Pharmacy (TSBP) the flexibility to establish new classes of pharmacy licenses under any conditions. As proposed, S.B. 1315 allows TSBP to issue a new class of pharmacy license if TSBP determines it necessary based on certain conditions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 554.001, Occupations Code, by adding a new Subsection (e) to authorize the Texas State Board of Pharmacy (TSBP) to establish additional classes of pharmacy licenses if it determines that certain criteria are met. SECTION 2. Amends Subsections[sic] (a), Section 560.051, Occupations Code, to add a new Subdivision (6) relating to the classifications for a pharmacy license. SECTION 2[sic]. Amends Section 562.001, Occupations Code, by adding a new Subsection (g) to require pharmacist supervision, for other Classes of pharmacy licenses created by TSBP under the authority granted in Section 554.001, to be designated by board rule. Requires supervision to be no less than continuous supervision by a pharmacist according to the needs of the pharmacy. SECTION 3[sic]. Effective date: September 1, 2001[sic].
