SRC-TAG S.B. 1332 78(R) BILL ANALYSIS Senate Research Center S.B. 1332 By: Barrientos Education 4/2/2003 As Filed DIGEST AND PURPOSE There have been several lawsuits from students and faculty alleging that public universities are unfairly restricting free speech on campus. As proposed, S.B. 1332 prevents state institutions of higher education from over-regulating speech or assembly on campus. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 51G, Education Code, Section 51.352, by adding Subsection (g) to prohibit a governing board of a state institution of higher education from establishing a regulation of time, place and manner of speech and assembly that is more restrictive than necessary to protect normal academic and institutional activities. SECTION 2. Effective date: upon passage or September 1, 2003.
