SRC-JEC, EPT, MSY S.B. 1388 78(R)BILL ANALYSIS Senate Research CenterS.B. 1388 By: Armbrister State Affairs 6/23/2003 Enrolled DIGEST AND PURPOSE Current Texas law allows certain law enforcement officials to make application to remove certain personal information from the public record. S.B. 1388 makes public documents filed with a county clerk and all documents filed with a district clerk exempt from such requests. The bill provides that certain information of current or former employees of the Texas Department of Criminal Justice is excepted from the requirements of Section 552.021. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 552.117, Government Code, as follows: (a) Provides that information is excepted from the requirements of Section 552.021 if it is information that relates to the home address, home telephone number, or social security number of certain persons including a current or former employee of the Texas Department of Criminal Justice or of the predecessor in function of the department or any division of the department, regardless of whether the current or former employee complies with Section 552.1175, or if it is information that reveals whether the person has family members. (b) Provides that all documents filed with a county clerk and all documents filed with a district clerk are exempt from this section. SECTION 2. Amends Section 552.1175, Government Code, by amending Subsection (a) and adding Subsection (e) as follows: (a) Makes conforming changes. (e) Makes conforming changes. SECTION 3. Provides that the changes in law made by this Act to Sections 552.117 and 552.1175, Government Code, applies to information about former employees of the Texas Department of Criminal Justice or of the predecessor in function of the department or any of the department's divisions without regard to whether the information was created or acquired on, before, or after the effective date of this Act. SECTION 4. Effective date: upon passage or September 1, 2003.
