DIGEST AND PURPOSE 

The state's National Guard facilities are in need of maintenance and
repair.  The federal government's fiscal year ends in September and the
state fiscal year ends in August.  Federal funds regularly become
available to Texas in late August, but those monies are lost because of
the time frame and the lack of a process to identify and acquire matching
funds.  S.B. 1439 establishes authorizes the governor, in consultation
with the adjutant general and the executive director of the Texas Military
Facilities Commission, to direct money, appropriated for the purpose, to
direct money to projects at military installations that would  enable the
state to receive federal matching funds. 


RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter A, Chapter 431, Government Code, by adding
Section 431.017, as follows: 

Sec. 431.017.  MILITARY FACILITIES PROJECTS:  MATCHING FEDERAL FUNDS.
Authorizes the governor, if the governor, after consulting with the
adjutant general and the executive director of the Texas Military
Facilities Commission, finds that the state is eligible for federal
matching funds for projects at military facilities in this state, to
direct that money appropriated for the purpose be used to obtain the
federal matching funds. 

SECTION 2.  Effective date: September 1, 2003.
