C.S.S.B. 1439 78(R) BILL ANALYSIS C.S.S.B. 1439 By: Shapleigh Defense Affairs and State-Federal Relations Committee Report (Substituted) BACKGROUND AND PURPOSE The State's National Guard facilities are in need of maintenance and repair. The federal government's fiscal year ends at the end of September and the state's fiscal year ends at the end of August. Federal funds regularly become available to Texas in late August, but those monies are sometimes lost because of the timeframe and the lack of a process to identify and acquire matching funds. C.S.S.B. 1439 authorizes the Governor, after consulting with the Adjutant General and the executive director of the Military Facilities Commission, to direct that money appropriated for the purpose be used to obtain the federal matching funds for projects at military facilities in Texas. RULEMAKING AUTHORITY It is the opinion of the Committee that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. C.S.S.B. 1439 allows the Governor to direct certain state monies to obtain federal matching funds for projects at military facilities in Texas after consulting with the Military Facilities Commission and the Texas Adjutant General. SECTION 2. This Act takes effect September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE: The substitute modifies the Senate engrossed version of the bill in SECTION 1 by striking the Military Facilities Funding Board and requires consultation with certain persons instead.
