DIGEST AND PURPOSE 

The state's National Guard facilities are in need of maintenance and
repair.  The federal government's fiscal year ends in September and the
state fiscal year ends in August.  Federal funds regularly become
available to Texas in late August, but those monies are lost because of
the timeframe and the lack of a process to identify and acquire matching
funds.  C.S.S.B. 1439 establishes the composition of the Military
Facilities Funding Board (board) and authorizes the governor, with the
concurrence of the board, to direct money, appropriated for the purpose,
to be used to obtain the federal matching funds when governor becomes
aware of the possibility of matching funds for projects at military
facilities in the state. 


RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter A, Chapter 431, Government Code, by adding
Section 431.017, as follows: 

Sec. 431.017.  MILITARY FACILITIES PROJECTS: MATCHING FEDERAL FUNDS. (a)
Sets forth the composition of the Military Facilities Funding Board. 

(b) Provides that if the governor finds that the state is eligible for
federal matching funds for projects at military facilities in this state,
the governor is authorized, with the concurrence of the Military
Facilities Funding Board, to direct that the money appropriated for the
purpose be used to obtain the federal matching funds. 

SECTION 2.  Effective date: September 1, 2003.
